Welcome to Georgia Law Update. This site has been developed for the benefit of lawyers, law students, judges and anyone who is interested in Georgia criminal cases.


Georgia Law Update is a subscription website,
featuring the most current analytical research on Georgia criminal case law available anywhere.  Georgia Law Update is written by Judge Ben W. Studdard of the State Court of Henry County, Georgia. Judge Studdard reviews new decisions from the Georgia Supreme Court and Georgia Court of Appeals daily and each week adds them to his copyrighted outline of Georgia criminal law. 

Each concise case note features the central holding of the decision, usually in an exact quote, with sufficient context to allow comparison to other cases.  Judge Studdard then adds appropriate cross-references to other cases on the same subject, often cases that aren’t referenced in the decisions themselves.  Where appropriate, he adds his own personal commentary. Judge Studdard also includes pertinent decisions from the U.S. Supreme Court and Eleventh Circuit, particularly in the areas of Search and Seizure and other constitutional issues.

 

When you purchase an annual subscription, you'll have access to our digest in digital format for your reference 24 hours a day, 7 days a week. The format of the website allows you to copy and paste the case note directly into a Microsoft Word or WordPerfect document, for easy inclusion in your brief or order.

Georgia Law Update is updated 50 weeks per year so that you are provided with the very latest reference materials – usually with notes on all decisions issued through the previous Friday. It is an extensive collection comprised of over 1600 pages of information.

It is indexed using over 1000 categorized chapters and subchapters, designed to be intuitive for the user to locate.  Navigation between pages is easy, using the index shown on the left side of the browser window. With just a few minutes reviewing our FAQ page and studying the 19 major subject-headings of the index, the user should be able to quickly locate the most recent cases on any subject.

How to subscribe

Annual subscriptions are $250.00 for the first attorney or judge and $200.00 for each additional attorney in the same firm or each additional judge of the same court.  No additional charge for paralegals, judges, law clerks or non-attorney support staff working with attorneys and judges. The annual fee is $500.00 per law school.

Preface from our Author

Georgia Law Update grew out of annual presentations on new criminal case law to my colleagues on the State Court bench in Georgia. Collecting those materials, I have attempted to create a survey of Georgia criminal law since 1999 which deals with all issues of criminal law – substance, procedure, evidence, and constitutional issues – in the trial court.

My goal is to report any significant holding of every reported criminal case from the Georgia Court of Appeals and Supreme Court and, where applicable, the federal courts. I attempt to concisely state those holdings, with any relevant facts, where possible quoting from the case. The user can thus know that the case has been accurately reported, and may be able to use those quotes in orders, motions or briefs. I try to make appropriate cross-references and comparisons to cases on related subjects (including cases which may not reference one another.) Issues which arise solely on appeal or on petition for habeas corpus are beyond the scope of this work. Issues unique to juvenile proceedings currently are beyond the scope, as are forfeiture proceedings related to criminal prosecutions.
